Howard Brody expresses concern that citing the “two cases that put futility on the map,” namely Helga Wanglie and Baby K, may be providing ammunition to the opponents of the concept of medical futility. He in fact joins well-known opponents of the concept of medical futility in arguing that it is one thing for the physician to say whether a particular intervention will promote an identified goal, quite another to say whether a goal is worth pursuing. In the latter instance, (...) physicians are laying themselves open “to the criticism of taking on basic value judgments that are more appropriately left to patients and their surrogates.” Brody states that in both the Wanglie and Baby K cases, the “basic value judgments” had to do with the worthiness of maintaining unconscious life via medical technology. He classifies this as “a question of professional integrity—but not a question of futility,” adding that “more than semantics hinges on this distinction.” The “more than semantics” factor is a pragmatic, even political one. Failure to make this distinction renders physicians “that much more suspect and less trustworthy in the public debate.”. (shrink)

A philosophical essay under this title faces severe rhetorical challenges. New accounts of the good life regularly and rapidly turn out to be variations of old ones, subject to a predictable range of decisive objections. Attempts to meet those objections with improved accounts regularly and rapidly lead to a familiar impasse — that while a life of contemplation, or epicurean contentment, or stoic indifference, or religious ecstasy, or creative rebellion, or self-actualization, or many another thing might count as a good (...) life, none of them can plausibly be identified with the good life, or the best life. Given the long history of that impasse, it seems futile to offer yet another candidate for the genus “good life” as if that candidate might be new, or philosophically defensible. And given the weariness, irony, and self-deprecation expected of a philosopher in such an impasse, it is difficult for any substantive proposal on this topic to avoid seeming pretentious. (shrink)

There is much more said in the Critique of Pure Reason about the relationship between God and purposiveness than what is found in Kant's analysis of the physico-theological argument. The ‘Wise Author of Nature’ is central to his analysis of regulative principles in the ‘Appendix to the Transcendental Dialectic’ and also appears in the ‘Canon’, first with regards to the Highest Good and then again in relation to our theoretical use of purposiveness. The tendency to reciprocate – to return good for good and evil for evil – is a potent force in human life, and the concept of reciprocity is closely connected to fundamental notions of ‘justice’, ‘obligation’ or ‘duty’, ‘gratitude’ and ‘equality’. In _Reciprocity_, first published in 1986,_ _Lawrence Becker presents a sustained argument about reciprocity, beginning with the strategy for developing a moral theory of the virtues. Inventors in the age of the Enlightenment created lifelike androids capable of playing music on real instruments. _Music and the Forms of Life_ examines the link between such simulated life and music, which began in the era's scientific literature and extended into a series of famous musical works by Haydn, Mozart, and Beethoven. Music invented auditory metaphors for the scientific elements of life (drive, pulse, sensibility, irritability, even metabolism), investigated the affinities and antagonisms between life and mechanism, and explored questions (...) of whether and how mechanisms can come to life. The resulting changes in the conceptions of both life and music had wide cultural resonance at the time, and those concepts continued to evolve long after. A critical part of that evolution was a nineteenth-century shift in focus from moving androids to the projection of life in motion, culminating in the invention of cinema. Weaving together cultural and musical practices, Lawrence Kramer traces these developments through a collection of case studies ranging from classical symphonies to modernist projections of waltzing specters by Mahler and Ravel to a novel linking Bach's _Goldberg Variations_ to the genetic code. Jnanasrimitra (975-1025) was regarded by both Buddhists and non-Buddhists as the most important Indian philosopher of his generation. His theory of exclusion combined a philosophy of language with a theory of conceptual content to explore the nature of words and thought. Jnanasrimitra's theory informed much of the work accomplished at Vikramasila, a monastic and educational complex instrumental to the growth of Buddhism. His ideas were also passionately debated among successive Hindu and Jain philosophers. The years since the world-wide demonstrations in the wake of George Floyd’s murder in 2020 have seen a significant embrace of antiracist education as part of moral education, followed by conservative rollback of such efforts. The article discusses both, and is applicable to the further retrenchment in the second Trump administration (in 2025). Antiracist moral and civic education should educate about both interpersonal racism (racism of individuals toward other individuals) and institutional racism (systemic racial injustices). Each of those areas involves (...) both “negative” values—avoiding racial wrongs—and “positive” values—promoting race-related goods. Negative interpersonal values include stereotyping, antipathy, and demeaning the other. Positive interpersonal values include respecting racial others as equals, recognizing positive racial differences, respecting cultures associated with racial groups. Negative institutional values are the most familiar—ending, mitigating, repairing systemic racial injustices. Positive institutional values include promoting racial justice, understanding, harmony, and a culture of respect throughout society represented in its institutions. Institutional racism requires civic education, in order to recognize patterns of injustice, to analyze their causes, and to be able to measure them against both morally sound and nationally salient ideals (such as equality, liberty, and justice). Antiracist education must be sensitive to students’ particular racial identities, and to asymmetries between the way white and non-white identities function morally and civicly. -/- Although sometimes it is important to ignore someone’s racial identity in interacting with them, “color-blindness,” promoted as an overarching principle by the Trump administration and the retrenchment legislation, cannot play that role. Antiracist education requires that we often take account of people’s race, and the issue is how to do that properly, not to ignore it entirely. (shrink)

Severally, issues in bioethics generate tensions on the ground that, while life is generally accepted to be valuable, the basis for this value is not often universally acceptable to all people. As result of this, theories of life and the basis, on which life should be found as valuable, often hinge differently on religion, morality, culture, customs etc., and are reliable only to the extent that they do not disagree or contradict one’s own standpoint as anchored on any of these. (...) In this wise then, religion, culture or customs strongly provide the grounds on which literatures on bioethics flourish. In this paper I intend to locate a fresh basis on which alternative theories of bioethics from the African worldview could be explored; one which will improve the literature on bioethics as well as diversify the ethical basis for life and, thereby, mediate in the tensions that define bioethical principles. I shall do this through an analysis of the important essay of the South African philosopher Thaddeus Metz “African and Western theories in a bioethical context”. Through a critical study of this essay and by providing the insight it offers on bioethics, I shall demonstrate how this theory provides positions that strongly suggest alternative but valuable basis for bioethical principles, anchored on African worldview and its theoretical and practical potentials in promoting the growth of literature on bioethics. In particular, the arguments that hold that there are natural rights derived from first occupancy, labour, utility, liberty and virtue are considered, as are the standard anti-property arguments based on disutility, virtue and inequality, and the belief that justice in distribution must take precedence over (...) private ownership. Lawrence Becker goes on to contend that there are four sound lines of argument for private property that, together with what is sound in the anti-property arguments, must be co-ordinated to form the foundations of a new theory. Critics have charged that Heidegger's account of authenticity is morally nihilistic, that his fundamental ontology is either egocentric or chauvinistic; and many see Heidegger's turn to Nazism in 1933 as following logically from an indifference, and even hostility, to "otherness" in the premises of his early philosophy. In_ The Fragile "We": Ethical Implications of Heidegger's "Being and Time,"_ Lawrence Vogel presents three interpretations of authentic existence--the existentialist, the historicist, and the cosmopolitan--each of which is a plausible version of the (...) personal ideal depicted in _Being and Time._ He then draws parallels between these interpretations and three moments in the contemporary liberal-communitarian debate over the relationship of the "I" and the "We." His book contributes both to a diagnosis of what there is about _Being and Time_ that invites moral nihilism and to a sense of how fundamental ontology might be recast so that "the other" is accorded an appropriate place in an account of human existence. The scientific consensus regarding anthropogenic climate change is firmly established yet climate change denialism, a species of what I call pseudoskepticism, is on the rise in industrial nations most responsible for climate change. Such denialism suggests the need for a robust ethics of inquiry and public discourse. In this paper I argue: (1) that ethical obligations of inquiry extend to every voting citizen insofar as citizens are bound together as a political body. (2) It is morally condemnable for public officials (...) to put forward assertions contrary to scientific consensus when such consensus is decisive for public policy and legislation. (3) It is imperative upon educators, journalists, politicians and all those with greater access to the public forum to condemn, factually and ethically, pseudoskeptical assertions made in the public realm without equivocation. Because of their specialized expertise and power, the task is both difficult and pressing. The work is divided into two parts. Part 1 discusses the concepts 'ethics' and 'professional conduct', indicating their dimensions and contested nature. In each case, following examination and analysis of relevant literature, a conceptual framework or model (...) is proposed for locating instances of, in turn, ethics and professional conduct. In Part 2, the model of ethical choice is used to discuss the ethical justification of professional conduct in the various forms, locations, and stages provided by its social setting. In this way, it provides grounding arguments for relevant action by professionals and others dealing with professionals. In this interview, the previous editor-in-chief of Theoria, Lawrence Hamilton, describes the evolution of Theoria to become a journal with more Southern political theory scholars and ideas, and how this was inspired by the limitations of Northern theory alone in understanding real world political problems in South Africa especially. He traces the evolution of this thought in becoming a more ‘decolonial’ type thinker through his own work, and how this intersected with Theoria's focus, with specific reference to special issues (...) of the journal including ‘Freedom and Power’ in 2013, ‘Empire and Economics’ in 2016 and a series of African-focussed editions in 2018, 2019 and 2021. At the heart of this lived experienced of intellectual development is a validation of the importance of context-based theory and theorising that is nevertheless still engaged with northern thought and global issues. In this paper, I want eventually to get around to proposing a criterion of identity for events which are changes in physical objects, where events are construed as comprising a distinct metaphysical category of thing. The proposal will be preceded by a discussion of what I take to be a mistaken suggestion for such a criterion; I will do that because I think that seeing what it takes to show why that suggestion fails helps to motivate a theory about what (...) it is to be an event; and that theory wi II supply the conceptual foundations for my proposal concerning the criterion of identity for events. Before that suggestion is discussed, however, I want to discuss briefly an aspect of the question, Why do we have to give a criterion of identity for events, or for objects of any sort whatsoever? I want to have a brief look at the connection between identity criteria and the idea of a kind of object. (shrink)

Is it self-evident that every Kenyan adult citizen should have the right to vote at national and civic elections or referenda? This is not always the case: certain segments of the population are expressly or implicitly excluded by law or practice from the franchise. This paper suggests that the concept of unsoundness of mind should no longer be the basis for excluding persons with disabilities generally, and those with intellectual disabilities in particular, from voting. It traces provisions in law that (...) disenfranchise persons adjudged to be of unsound mind; and provides interpretation using national law as well as international human rights norms to infer that general or automatic disenfranchisement is a human rights violation. It concludes that Kenya’s electoral authorities must ensure that neither their policies nor the practices of their officials disenfranchise some Kenyan adults from voting by equating such persons’ mental illness or intellectual disabilities with “unsoundness of mind”. This essay develops an ideal of public legal reason--a normative theory of legal reasons that is appropriate for a society characterized by religious and moral pluralism. One of the implications of this theory is that normative theorizing about public and private law should eschew reliance on the deep premises of deontology or consequentialism and should instead rely on what the author calls public values--values that can be affirmed without relying on the deep and controversial premises of particular comprehensive moral doctrines. The ideal of public legal reason is then applied to a particular question--whether welfarism (a particular form of normative law and economics) provides the sort of reasons that appropriate for legal practice. The answer to that question is no--to the extent that welfarism contends that the normative assessment of legal policies should rely exclusively on information about individual preferences, welfarism relies on deep and controversial premises of consequentialist moral theory that fail the test of public reason. The essay also investigates the thesis--advanced by Louis Kaplow and Steven Shavell--that any fairness principle (a nonwelfarist method of policy assessment) can violate weak Pareto (making everyone worse off). Whatever the implications of Kaplow and Shavell's argument, it does not show that welfarism can provide public legal reasons. The essay concludes that law's justifications should rely on normative principles that are accessible to reasonable citizens, whether they are theists or atheists, deontologists or consequentialists, moral philosophers or economists. Law's deliberations should be shallow and not deep. Law's reason should be public. (shrink)

This book offers a complete and internally cohesive interpretation of Religion. In contrast to the interpretations that characterize Religion as a litany of “wobbles”, fumbling between traditional Christianity and Enlightenment values, or a text that reduces religion into morality, the interpretation here offered defends the rich philosophical theology contained in each of Religion’s four parts and shows how the doctrines of the “Pure Rational System of Religion” are eminently compatible with the essential principles of Transcendental Idealism.

Aquinas’s Five Ways are not to be understood as demonstrative proofs, successful or not, for the existence of God. Rather, they provide a necessary step towards supplying licensable surrogates for the essential predications that cannot logically be drawn from the incomprehensible nature of God, yet would seem needed for the Summa’s declared genre of argued theology. (Predication secundum analogiam provides surrogates for non-relational accidental predications, likewise unavailable.) What Aquinas is proving in arguing deum esse in ST I.2.3 is not God’s (...) actual existence (see ST I.3.4 ad 2) but an alternative interpretation of “God’s being something” where “God is something” is a placeholder for, say, “God is prime mover” or, more explicitly, for such (necessary) identities as “The prime mover is the necessitated necessitator,” an identity whose necessity depends at more than one place on the assumption of God’s existence from faith, not on demonstrative proof of God’s existence. Prior to the twentieth century, theories of knowledge were inherently perceptual. Since then, developments in logic, statis- tics, and programming languages have inspired amodal theories that rest on principles fundamentally different from those underlying perception. In addition, perceptual approaches have become widely viewed as untenable because they are assumed to implement record- ing systems, not conceptual systems. A perceptual theory of knowledge is developed here in the context of current cognitive science and neuroscience. During perceptual experience, association areas in the (...) brain capture bottom-up patterns of activation in sensory-motor areas. Later, in a top-down manner, association areas partially reactivate sensory-motor areas to implement perceptual symbols. The stor- age and reactivation of perceptual symbols operates at the level of perceptual components – not at the level of holistic perceptual expe- riences. Through the use of selective attention, schematic representations of perceptual components are extracted from experience and stored in memory (e.g., individual memories of green, purr, hot). As memories of the same component become organized around a com- mon frame, they implement a simulator that produces limitless simulations of the component (e.g., simulations of purr). Not only do such simulators develop for aspects of sensory experience, they also develop for aspects of proprioception (e.g., lift, run) and introspec- tion (e.g., compare, memory, happy, hungry). Once established, these simulators implement a basic conceptual system that represents types, supports categorization, and produces categorical inferences. These simulators further support productivity, propositions, and ab- stract concepts, thereby implementing a fully functional conceptual system. Productivity results from integrating simulators combinato- rially and recursively to produce complex simulations. Propositions result from binding simulators to perceived individuals to represent type-token relations. Abstract concepts are grounded in complex simulations of combined physical and introspective events. Thus, a per- ceptual theory of knowledge can implement a fully functional conceptual system while avoiding problems associated with amodal sym- bol systems. Implications for cognition, neuroscience, evolution, development, and artificial intelligence are explored. (shrink)

This paper is structured as follows. First, it offers a brief presentation of the Twin Earth thought experiment. Second, it offers an interpretation of Putnam'santi-realism. Third, it argues for the incompatibility of anti-realism and the semantic role of extension that Twin Earth is supposed to establish.

In the Fifth Meditation, Descartes makes a remarkable claim about the ontological status of geometrical figures. He asserts that an object such as a triangle has a 'true and immutable nature' that does not depend on the mind, yet has being even if there are no triangles existing in the world. This statement has led many commentators to assume that Descartes is a Platonist regarding essences and in the philosophy of mathematics. One problem with this seemingly natural reading is that (...) it contradicts the conceptualist account of universals that one finds in the Principles of Philosophy and elsewhere. In this paper, I offer a novel interpretation of the notion of a true and immutable nature which reconciles the Fifth Meditation with the conceptualism of Descartes' other work. Specifically, I argue that Descartes takes natures to be innate ideas considered in terms of their so-called 'objective being'. (shrink)

In Can We Live Together? Alain Touraine combines a consummate analysis of crucial social tensions in contemporary societies with a strong normative appeal for a new emancipatory 'Subject' capable of overcoming the twin threats of atomisation or authoritarianism. He calls for a move from 'politics to ethics' and then from ethics back to politics to enable the new Subject to make a reality out of the goals of democracy and solidarity. However, he has little to say about the nature of (...) such an ethics. This article argues that this lacuna could usefully be filled by adopting a form of radical humanism found in the work of Erich Fromm. It defies convention in the social sciences by operating from an explicit view of the 'is' and the 'ought' of common human nature, specifying reason, love and productive work as the qualities to be realised if we are to move closer to human solidarity. Although there remain significant philosophical and political differences between the two positions, particularly on the role to be played by 'the nation', their juxtaposition opens new lines of inquiry in the field of cosmopolitan ethics. Catholic doctrine’s strict prohibition on abortion can lead clinicians or institutions to conscientiously refuse to provide abortion, although a legal duty to provide abortion would apply to anyone who refused. Conscientious refusals by clinicians to end a pregnancy can constitute murder or reckless homicide under American law if a woman dies as a result of such a refusal. Such refusals are not immunized from criminal liability by the constitutional right to the free exercise of religion or by statutes that confer (...) immunity from criminal homicide prosecution. Core principles of the rule of law require the state to protect the lives of all persons equally and to place the life and health of persons above any the interests of providers have in moral integrity or in respecting the moral status of prenatal humans. In some states criminal liability related to conscientious objection also applies to corporate hospital officials. (shrink)

The words ‘racist’ and ‘racism’ have become so overused that they nowconstitute obstacles to understanding and interracial dialogue about racial matters. Insteadof the current practice of referring to virtually anything that goes wrong or amiss withrespect to race as ‘racism,’ we should recognize a much broader moral vocabulary forcharacterizing racial ills – racial insensitivity, racial ignorance, racial injustice, racialdiscomfort, racial exclusion. At the same time, we should fix on a definition of ‘racism’ thatis continuous with its historical usage, and avoids (...) conceptual inflation. I suggest two basic,and distinct, forms of racism that meet this condition – antipathy racism and inferiorizingracism. We should also recognize that not all racially objectionable actions are done froma racist motive, and that not all racial stereotypes are racist. (shrink)
